General Terms and Conditions of Vandeyk Contemporary Cycles GmbH
1. General
Our deliveries are made exclusively in accordance to the following Terms and Conditions.
2. Conclusion of Contract
2.1. Our offerings published in the online shop are non-binding.
2.2. By placing an order in the online shop, the customer makes a binding offer to purchase the selected product.
2.3. VANDEYK GmbH sends an e-mail confirmation of receipt to the customer. The order is accepted by sending an e-mail acceptance of the order or by dispatching the product. The sales contract with the customer will not become effective until our acceptance.
2.4. Any Customer can revoke the offer and return the product in accordance to our cancellation and return policy.
3. Prices and Payment
3.1. Our prices include statutory VAT. Any customs duties and similar public charges shall be borne by the customer.
3.2. Payment can be made via credit card and PayPal at the time of the order. We reserve the right to refuse certain methods of payment.
4. Withdrawal Policy
4.1. Right of Withdrawal: You have the right to withdraw from this contract within 30 days without giving any reason. The withdrawal period will expire after 30 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail).
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right to withdrawal before the withdrawal period has expired to the following address:

4.2. Effects of Withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from the contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless we have expressly agreed otherwise; in any event, you will not incur any fee as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earliest.
5. Return Policy
5.1. If on receipt of your product, you are uncertain about your purchase please keep your product in the original packaging until you have decided whether or not you wish to keep it. All returns should be in ‘as new’ condition, both unwashed and unworn.
When returning items to VANDEYK, please ensure the product is well packaged and protected from damage in transit.
5.2. Exchanges: If you would like to make an exchange on your purchase please follow the steps in ‘How to make a return’. Exchanges can be made on a like-for-like basis, this means a different size or colour of the same product. If you would like a different product, please use the same process to return the item for a refund and place a new order.
5.3. Faulty Goods: We are committed to product excellence, although, from time-to-time manufacturing faults can occur. If you think your product has suffered a manufacturing fault please contact us. Items that are damaged as a result of excessive or long term usage are not considered faulty. Returned items that have been worn should be laundered before return, receipt of unwashed garments may result in your product being returned to sender.
5.4. How To Make a Return:

without delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. We will bear the costs of returning the goods and give a refund to you.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
6. Data Protection
6.1. We may save and process any data relating to the Customer, to the extent necessary for the purpose of the execution and implementation of the sales contract and as long as we are required to keep such data in accordance with applicable law.
6.2. We shall neither make available any personal data of the Customer to other third parties without the express consent of the Customer, except to the extent that we are required to disclose any data pursuant to applicable law.
6.3. We shall not be permitted to collect, submit to any third party or otherwise process personal data of the Customer for any purpose other than those set forth in this Section.
7. Delivery and Availability of Goods
If for any reason the products ordered by you are not available at the time you place your order, we will notify you by email. Our acceptance of your order in the acceptance email is limited to the products that are available. No contract of sale will be concluded in respect of products that are not available.
8. Delivery Times
Please note that stated delivery dates are approximate dates (circa), unless expressly agreed otherwise.
9. Delivery Service
Upon request we offer you the ability to specify a different delivery address, e.g. for gift purposes or if you are not able to receive your package at home. Please specify a billing and a shipping address when ordering.
10. Warranty
The customer has warranty rights if the purchased merchandise is defective in the moment that the risk is passed pursuant to § 437 ff. BGB (German Civil Code). The customer is entitled to rectification, withdrawal, compensation, reduction and reimbursement of expenses. Primarily, the customer may demand supplementary performance in the form of defect removal or replacement. However, we reserve the right to the right to replace by new delivery if the remedial measures would involve disproportionate effort.
This warranty does not cover damages caused by natural wear and tear, improper use and lack of or improper maintenance. The warranty expires two years after delivery of the goods.
11. Applicable Law
Any contracts entered into between us and the Customer shall be governed by the laws of the Federal Republic of Germany under exclusion of the UN Convention on the International Sale of Goods (CISG), without prejudice to any mandatory conflict of laws provisions.
